제1장 총칙
Chapter 1. General Provisions

 

제1조 목적
Article 1. Purpose

본 규정은 SEC(Sustainable Enterprise Evaluation Commission)가 실시하는 ESG 평가의 사실확인(Factual Review) 절차에 관한 사항을 규정함으로써 평가자료의 정확성, 평가절차의 객관성 및 평가대상 기관 또는 기업의 권리 보호를 도모함을 목적으로 한다.

These Regulations establish procedures for Factual Review in SEC ESG evaluations in order to ensure the accuracy of evaluation materials, objectivity of evaluation procedures, and protection of the rights of evaluated organizations and companies.

 

제2조 적용범위
Article 2. Scope of Application

본 규정은 SEC가 실시하는 모든 ESG 평가에 적용한다.

These Regulations shall apply to all ESG evaluations conducted by SEC.

 

제3조 기본원칙
Article 3. Fundamental Principles

사실확인(Factual Review)은 다음 각 호의 원칙에 따라 운영한다.

Factual Review shall be administered in accordance with the following principles.

① 정확성 (Accuracy)
② 객관성 (Objectivity)
③ 공정성 (Fairness)
④ 투명성 (Transparency)
⑤ 권리보호 (Protection of Rights)

 

제4조 정의
Article 4. Definitions

“사실확인(Factual Review)”이란 예비평가 결과에 포함된 사실관계의 정확성을 검증하기 위한 절차를 말한다.

“Factual Review” means a procedure to verify the accuracy of factual information contained in preliminary evaluation results.

Chapter 2. Request for Factual Review

 

제5조 사실확인 요청권
Article 5. Right to Request Factual Review

평가대상 기관 또는 기업은 예비평가 결과에 포함된 사실관계에 대하여 사실확인을 요청할 수 있다.

Organizations or companies subject to evaluation may request verification of factual matters contained in preliminary evaluation results.

 

제6조 요청대상
Article 6. Matters Eligible for Review

다음 각 호는 사실확인 요청대상이 될 수 있다.

The following matters may be subject to Factual Review.

 

① 사실오인
Factual Errors

② 자료누락
Omission of Relevant Information

③ 수치·통계 오류
Numerical or Statistical Errors

④ 공개자료 반영 누락
Failure to Reflect Publicly Available Information

 

제7조 요청기간
Article 7. Filing Period

사실확인 요청은 SEC가 정한 기간 내에 제출하여야 한다.

Requests for Factual Review shall be submitted within the period prescribed by SEC.

 

제8조 요청방법
Article 8. Method of Submission

사실확인 요청은 SEC가 정한 양식에 따라 서면 또는 전자문서로 제출한다.

Requests shall be submitted in writing or electronically using forms prescribed by SEC.

제3장 사실확인 심사
Chapter 3. Review Procedure

 

제9조 보완자료 제출
Article 9. Submission of Supporting Materials

평가대상 기관 또는 기업은 객관적 근거자료를 제출할 수 있다.

Organizations or companies may submit objective supporting materials.

 

제10조 심사주체
Article 10. Reviewing Authority

사실확인은 SEC 사무국 및 평가실무진이 수행한다.

Factual Review shall be conducted by the SEC Secretariat and evaluation staff.

 

제11조 심사
Article 11. Review

SEC는 제출자료의 객관성, 신뢰성 및 적정성을 검토한다.

SEC shall review the objectivity, reliability, and appropriateness of submitted materials.

 

제12조 추가자료 요청
Article 12. Request for Additional Information

SEC는 필요하다고 인정하는 경우 추가자료 제출을 요구할 수 있다.

SEC may request additional information where deemed necessary.

제4장 사실확인의 범위
Chapter 4. Scope and Limitations

 

제13조 사실확인의 범위
Article 13. Scope of Review

사실확인은 사실관계 검증에 한정한다.

Factual Review shall be limited to verification of factual information.

 

제14조 사실확인의 한계
Article 14. Limitation of Factual Review

사실확인은 평가기준, 평가철학, 평가방법론 또는 평가정책의 변경을 요구하는 절차로 활용될 수 없다.

Factual Review shall not be used to request changes to evaluation criteria, evaluation philosophy, methodologies, or policies.

 

제15조 평가독립성 보호
Article 15. Protection of Evaluation Independence

사실확인 절차는 평가의 독립성과 객관성을 침해하는 수단으로 이용되어서는 아니 된다.

The Factual Review process shall not be used in a manner that impairs the independence or objectivity of evaluations.

제5장 결과반영
Chapter 5. Reflection of Review Results

 

제16조 결과반영
Article 16. Reflection of Results

SEC는 사실확인 결과가 타당하다고 인정되는 경우 평가결과에 반영할 수 있다.

SEC may reflect verified findings in evaluation results where deemed appropriate.

 

제17조 결과통보
Article 17. Notification of Results

SEC는 사실확인 결과를 평가대상 기관 또는 기업에 통보한다.

SEC shall notify evaluated organizations or companies of Factual Review outcomes.

 

제18조 기록관리
Article 18. Recordkeeping

사실확인 관련 자료는 평가기록으로 보존한다.

Materials related to Factual Review shall be maintained as evaluation records.

제6장 다른 규정과의 관계
Chapter 6. Relationship with Other Regulations

 

제19조 이의신청과의 관계
Article 19. Relationship with Appeal

사실확인 절차 종료 후 평가대상 기관 또는 기업은 「SEC 이의신청(Appeal) 심사규정」에 따라 이의신청을 제기할 수 있다.

Upon completion of Factual Review, evaluated organizations or companies may submit an Appeal in accordance with the SEC Appeal Review Regulations.
 

 

제20조 평가등급 운영규정과의 관계
Article 20. Relationship with ESG Rating Regulations

본 규정은 「SEC ESG 평가등급 운영규정」과 연계하여 적용한다.

These Regulations shall be applied in conjunction with the SEC ESG Rating Regulations.

 

제21조 평가 거버넌스 체계
Article 21. Evaluation Governance Framework

본 규정은 SEC 평가 거버넌스 체계의 구성 규정으로 운영한다.

These Regulations shall operate as a constituent regulation of the SEC Evaluation Governance Framework.

부칙
Supplementary Provisions

 

제1조 시행일
Article 1. Effective Date

본 규정은 2026년 1월 1일부터 시행한다.
These Regulations shall enter into force on January 1, 2026.

 

제2조 규정의 개정
Article 2. Amendment of Regulations

본 규정의 개정은 평가위원회의 심의를 거쳐 시행한다.

Any amendment to these Regulations shall be adopted following deliberation by the Evaluation Committee.
